Terms of Service

By purchasing services from Brainstorm Club, you agree to the following Terms of Service.

1. Services Provided

Brainstorm Club offers flexible marketing consultancy services designed to align your sales and marketing efforts, with a focus on long-term growth. Our services include:

  • Revenue growth consultancy
  • Sales & marketing alignment
  • CRM optimisation
  • Marketing & email automation
  • Sales process automation
  • Strategy development and team enablement

2. Points System

Our pricing model operates on a points-based system:

  • 1 point = £100 + VAT.
  • You can purchase points and allocate them across any of our services based on your needs.
  • Unused points are valid for 90 days from the date of purchase and can be rolled over to the next month.
  • Points must be used within the 90-day window; otherwise, they will expire.

Brainstorm Club reserves the right to change the cost of a point at any time. However, this change will not impact points that have already been purchased.

3. Payments and Invoices

Payments are due upfront at the time of purchase. You will receive an invoice detailing the points purchased and their corresponding services. Each service or task has a pre-defined point value, so you will always know the exact cost before starting a project.

4. Refunds

Refunds are not provided for paid points, except in extreme circumstances. If you feel a refund is warranted, please contact us via email at success@brainstormclub.com, and we will review the request on a case-by-case basis.

5. Late Payment

If payments are not made within the agreed timeframe, late fees of 1.5% per month may be charged on any outstanding balance. Services may be suspended until payment is made.

6. Service Changes

Brainstorm Club reserves the right to change the services offered or the Terms of Service at any time. You will be notified of any significant changes.

7. Confidentiality

Brainstorm Club agrees to maintain the confidentiality of all proprietary information received during our partnership. We will not disclose any of your confidential information without prior consent unless required by law.

8. Limitation of Liability

Brainstorm Club’s liability is limited to the total fees paid for the specific service provided. We are not responsible for any indirect or consequential damages arising from the services rendered.

9. Dispute Resolution

In case of any disputes, we encourage resolution through negotiation. If a resolution cannot be reached, the dispute will be submitted to mediation. If mediation fails, the dispute will be governed by the laws of England and Wales.

10. Termination

Either party can terminate the services with 30 days’ written notice. Services will continue until the end of the current month or point balance.

11. Force Majeure

Brainstorm Club is not responsible for delays or failure to perform services due to factors beyond our control, such as natural disasters or other unforeseen events.

12. Intellectual Property

Any intellectual property created during our work is owned by Brainstorm Club until payment is completed. Upon full payment, the intellectual property will be transferred to the client.

13. Indemnity

The client agrees to indemnify Brainstorm Club from any claims, losses, or damages arising from the client’s use of the services provided.

14. Non-Solicitation

Clients agree not to solicit or hire any Brainstorm Club staff or contractors during the term of service and for one year after the contract ends.

15. Governing Law

These terms are governed by the laws of England and Wales, and any disputes will be resolved in the relevant courts in England and Wales.
